By using or accessing Ownerhomeholidays (the "Site"), you acknowledge that you are subject to the following terms and conditions (the "Terms of Use"). Please read through our Terms and Conditions carefully. By using our site, you indicate that you accept the Terms of Use. If you do not fully agree to these Terms, you must not access or otherwise use the Site.
Information about us
Ownerhomeholidays.com are a part of the Ownerhome Group. We provide an advertising service for holiday homeowners and an accommodation search facility for Holidaymakers. We do not own, inspect or provide content for any of the properties advertised on our site. We are not involved in the booking process or any transaction related to it, although we may provide tools to enable the transaction between Advertiser and Holidaymaker. We make no claims as to the quality, safety or legality of any of the properties advertised; neither can we confirm the accuracy of the advertisements or their content. The ability of Advertisers to rent holiday properties or the ability of travellers to pay for holiday rental properties is solely the responsibility of the users. We do not own nor can we enter into any contract concerning any property listed on the Site.
Personal use
Photographs, images, property descriptions and all other content published on this website are copyright of Ownerhomeholiday and may not be copied from this site and reproduced in any other advertisement or marketing, without our written consent. We grant users limited, revocable, non-exclusive license to access the site to: a) Advertise holiday rental properties and/or b) Search, view or make legitimate enquiries to Advertisers regarding their interest in a particular holiday rental property, for personal use only, in accordance with these terms.
For your own security
Due to the nature of advertisements and transactions taking place on the Internet, there are always risks involved. We would therefore encourage both Advertisers and Holidaymakers to proceed with caution and use their own judgement. As you may never actually speak or make physical contact with either parties.
Your privacy and security
Your personal details are held on a secure database and only those details you wish to be published are made available to our site visitors. We do not pass confidential customer information to other organisations (see our privacy policy).
Indemnity
Ownerhomeholidays do not enter into any contract concerning any property listed on our site. We provide an advertising service only; any contract entered into is solely between the Advertiser and the Holidaymaker. Therefore, you agree to waive any claim that may arise as a direct result of a dispute with another member of the site, or any other third party: and compensate us for any loss or liability suffered, as a result of any claim made against us by another user or third party, resulting from your use of our site or dealings you have had with users and third parties.
Our responsibility and limitation of liability
Whilst every effort is made to assure information on our site is accurate and up to date, we have no control over any property advertised on our site. We cannot validate nor provide any warranties for information given by an Advertiser or Holidaymaker. It is the responsibility of the Advertiser to provide an accurate and truthful description of their properties. We agree to take reasonable steps to remove any property advert following a complaint from a Holidaymaker, Advertiser or third party. We will not be held liable, or claim responsibility for any content added to our site and users should not rely on the information published by way of advertisements, links or news feeds. If Ownerhomeholidays or any of it's members breach these terms, we will only claim liability for any losses suffered as a direct result and to the extent that they are a foreseeable consequence of both parties at the time of using our site. The maximum liability for any loss arising due to our negligence will be limited to a sum equal to the value of the advertising fee received. Nothing stated in these Terms shall exclude or restrict our liability for fraudulent misrepresentation, or for any negligence causing death or personal injury.
Interruption to service
We make every reasonable effort to ensure that our website facilities are available to Internet visitors and Advertisers at all times. However, we do not offer any guaranteed percentage time of availability and accept no financial liability for any interruption in service or temporary loss of some or all website facilities at any time. On occasion, necessary maintenance or upgrade work requires the site to be taken 'off-line' without notice, but we endeavour to keep downtime to a minimum and in most cases of scheduled maintenance, this normally involves no more than a few minutes. Our website is hosted in a secure protected environment with excellent security and backup measures in place and a very high level of service is anticipated.

Any links contained in our site are provided for your information only. We have no control over any content or information provided and accept no responsibility for any loss or damage arising from your use of these sites. This applies to any resources provided by third parties also.
Agencies
Nothing in these Terms or your use of the site constitutes as a partnership, joint venture, agency or employer-employee relationship.

Any notices that we may need to bring to your attention will be displayed on our website, or emailed to the address you provide to the site on registration. Notice shall be deemed to have been given upon receipt or within 24 hours after sending, unless we are notified that the email address is invalid. Under certain circumstances notice shall be given by recorded delivery post to the address provided on registration and shall be deemed to be given upon receipt of signature.
Amendments
We reserve the right to change these Terms at any time and post the new version on the site. When we do so, we will notify you of said changes to Terms on the site and the revised Terms will take effect immediately. We also reserve the right to change the rates of advertising. Any new rates will be applicable with immediate effect for all new advertisements and any renewals due after the date of rates changing.
Record of these Terms
We do not keep separate files of the Terms entered into by users of our site. It is your responsibility to keep a copy of these Terms for your records. Our Terms can be printed direct from the site, or saved and downloaded to your computer.
Additional Terms and Conditions for Advertisers
Please read the Additional Terms for Advertisers carefully before using the site. By advertising on our site you agree to accept the Terms.
Consent
By choosing to submit your property details to us for publication you are indicating:
- That you are the legal owner of the property with the sole right to rent it out as a Holiday home, or you have legal power of attorney on behalf of the property owner.
- That you agree to Ownerhomeholidays publishing these details for you.
- That the property details supplied by you are true and accurate and not misleading in any material way.
- That on receipt by us receiving your payment, advertising of your property will commence within 24 hours.
Eligibility
Every Advertiser agrees to provide upon request, proof of identification, proof of ownership of the property submitted for advertising on our site, or proof of authority to list the property. We reserve the right to review and/or amend any content supplied by an Advertiser including photographs.
Substitution of Properties
A property advertised on our site relates to one specific property only. This property must not be substituted in any way including changing of text or photographs, which relates to another property, without prior written consent from us. Any Advertiser found to have violated this condition may have their advertising rights revoced and any fees charged for the previous existing listing will be retained as compensation.
Multiple / co-located Properties
A property listed on our site pertains to an individual holiday unit available for a short-term holiday rental only. This cannot be multiple units, or an example of properties in a given region. Only one unit may be represented in any one advertisement unless you have prior written permission from us. We reserve the right to amend or terminate any property advert deemed to be in violation of this condition and any fees may be retained as compensation.
Availability calendar
It is a condition of your advertisement contract that your availability calendar gives a true reflection of the available dates for your holiday rental home. All Advertisers are required to update their calendars at least once per month, even if there has been no change to the availability, but it is recommended that availability calendars are updated as soon as a booking is taken so as not to mislead site users. Any Advertiser found to be misrepresenting the availability of their property may have their calendar facility revoked. We reserve the right to terminate any advertisement without notice and retain any fee as compensation for any property deemed to have violated this Term.
Copyright
In respect of any property details or photographs submitted by you for publication, you confirm that you own full title to such details and /or photographs and you agree to grant a copyright license to Ownerhomeholidays. It is the Advertisers responsibility to ensure that they have copyright over any materials supplied to us for publication on their behalf and you agree to indemnify us in respect of any claims against us or expenses incurred by us in respect of breach of copyright issues. Photographs, images, property descriptions and all other content published on this website are copyright of Ownerhomeholidays and may not be copied from this site and reproduced in any other advertisement or marketing, without our written consent.
Unauthorised payment methods
No Advertiser may request payment for a holiday rental booking via cash sent through the post, or by any instant-cash wire transfer such as Money Gram or Western Union. Any violation of this Term may result in immediate termination of your listing without notice or refund. Acceptable payment methods are via credit card, cheque, Paypal or bank transfer.
External links and email addresses
We reserve the right to remove hypertext links, email addresses or other website addresses from advertisements without notice, if deemed to act against the interests of other Advertisers or us. If an Advertiser should re-add a link, website address or email addresses previously removed by us, we reserve the right to terminate their contract with immediate effect and retain any fees paid, as compensation for breaching this Term.
Termination of an advertisement
- We reserve the right to refuse or remove any advertisement from our site, which we consider to be unsuitable, sub-standard, misleading or incomplete in any way. Any current or prospective Advertiser agrees to release and hold us unaccountable for any loss or liability that may arise from this decision.
- We reserve the right to remove any advertisement deemed to contain unsuitable material from our site, or where the advertiser persistently misuses the online booking system in accordance with our Terms and Conditions, without refund or compensation to the Advertiser.
- Advertisements are sold to run the full term chosen by the Advertiser at the time of placing an advert. Advertisements may be removed before the end of their subscription with written confirmation from the Advertiser by email using our 'Contact Us' page, quoting their advertiser ID and email address used on registration. No refund will be offered.
- If we receive complaints from any user or entity regarding a specific advertisement relating to a misrepresentation of a property, it's facilities or surroundings. Or a report of inappropriate behaviour by an Advertiser, we reserve the right to remove the advertisement without notice. No refund will be offered.
- If an Advertiser is in breach of these Terms, we may without notice, remove the advertisement from our site without offering any refund.
Contactability
It is a requirement for all Advertisers to be available to respond to all email and telephone enquiries within a reasonable time period. If an Advertiser knows they are likely to be unavailable to answer rental enquiries we request that they leave a telephone answer machine message explaining this i.e. they are away on holiday themselves. Any advertiser that cannot be contacted for a period of 5 days or more, agrees to the temporary suspension of their advert, until such time as they contact us to by email quoting their advertisement ID and requesting that their property be re-activated. Ownerhomeholidays wish to maintain a high level of service to users of our site so contactability at all times is imperative.
Payment
Payment is required prior to any advertisement being activated. Payments made by debit or credit card are processed online by Paypal secure server (no Paypal account required) Advertisers holding a Paypal account can also make their payment via this method. Payments by cheque are also accepted and should be made payable to 'Owner home' and addressed to:

Refunds
No refund of our advertising fees will be made for loss of service, temporary or permanent, in any circumstances, after the expiry of the initial 7-day advertising period. Other circumstances may be reviewed and a refund offered at our discretion, however, under no circumstances will our liability exceed the value of the advertising fee received. This does not affect your statutory rights as a consumer.
Distance Selling Regulations
Clause 8(3) of The Consumer Protection (Distance Selling) Regulations 2000 states that the statutory cancellation (cooling-off) period of 7 days for services purchased over the internet, does not apply where performance of that service has already commenced with the customer's agreement. Our online payment facilities are designed to activate your public advertising automatically and therefore, by making a payment for advertising on this site you signify your agreement to the advertising service commencing IMMEDIATELY and that the standard cooling-off period does not apply as per clause 8(3) of the Regulations.
Law and jurisdiction
Any dispute pertaining to the provision of our service is subject to the laws of England & Wales.
